Agreement and contracting party

These Terms & Conditions (the “Terms”) form a binding agreement between you and the Axion contracting entity identified on your checkout, invoice or order confirmation. References to “Axion”, “we”, “us” or “our” mean that contracting entity and the Axion Funded brand through which the services are delivered.

Your order confirmation, invoice or checkout page may identify additional contracting information. If there is a conflict concerning the identity of the seller, the entity shown on the applicable order document controls.

These Terms incorporate the Privacy Policy, Refund Policy, Risk Disclosure, AML Policy, Cookies Policy, and the rules, objectives, restrictions and pricing displayed for the programme you purchase.

Nature of the Axion service

Axion provides digital access to simulated proprietary trading evaluations, virtual funded-stage accounts, trader dashboards, performance analytics, educational materials and related support services. Unless Axion expressly states otherwise in writing:

• all accounts, balances, orders, positions, market activity and profits shown inside an evaluation or funded stage are simulated;
• you do not trade or control Axion capital, customer deposits or a live brokerage account;
• evaluation fees are charges for digital services and access, not investments, deposits, stakes or managed funds;
• Axion is not acting as your broker, investment adviser, portfolio manager, fiduciary, bank or deposit-taking institution; and
• nothing supplied through the service is personalised financial, legal, tax or investment advice.

A reference to “funding”, “funded”, “capital”, “profit”, “balance” or similar language describes the simulated programme environment or a contractual reward calculation. It does not mean that a live trading account or client-money arrangement has been opened for you.

Eligibility and account registration

You may use Axion only if you are at least 18, have legal capacity to enter a contract, and are not prohibited from receiving the services under applicable law, sanctions, export controls or Axion’s restricted-jurisdiction rules.

You must provide complete, current and accurate information. You may be required to verify your email, telephone number, identity, address, payment ownership, tax information or source of funds. You must promptly correct information that becomes inaccurate.

Unless a programme expressly permits otherwise, each individual may maintain only one customer identity. Creating duplicate, synthetic, nominee or misleading identities, using another person’s verification documents, or allowing another person to trade or operate your account is prohibited.

Account security and authorised use

You are responsible for safeguarding login details, trading credentials, API keys, devices and authentication methods. Notify Axion immediately at support@axionfunded.com if you suspect unauthorised access.

You must not sell, transfer, sublicense, rent, share or commercially exploit an Axion account or programme access. Actions performed through your account are treated as authorised by you unless you notify us promptly and provide reasonable evidence of compromise.

Axion may require password resets, additional authentication or temporary access restrictions where necessary to protect the service, customers or payment systems.

Programme rules and evaluation objectives

Every programme has its own price, simulated account size, objectives, drawdown methodology, daily loss limits, maximum loss limits, minimum trading days, leverage, platform availability, prohibited practices, inactivity rules, reward split and review conditions. The rules displayed at checkout and in your dashboard at the time of purchase apply to that order.

You are responsible for understanding the selected programme before payment and for monitoring your own compliance. A dashboard indicator, warning or calculation is provided for convenience and does not transfer responsibility to Axion.

Axion may investigate activity for rule circumvention, technical abuse, copying, collusion, latency exploitation, price-feed manipulation, account sharing, prohibited automation, coordinated trading or other behaviour inconsistent with a genuine skills evaluation. Where a violation is reasonably established, Axion may invalidate results, close an account, deny progression or rewards, and suspend related accounts.

Orders, prices, taxes and payment

Prices, discounts and available payment methods are shown before you submit an order. You authorise Axion and its payment providers to charge the displayed total and to perform fraud, security and payment verification checks.

• Prices may be shown in a display currency while your bank or wallet applies conversion rates or additional charges.
• You are responsible for taxes, duties, bank fees, blockchain fees or similar charges imposed on you, except taxes Axion is legally required to collect.
• A coupon, promotion or pricing error may be corrected before access is supplied. Axion may cancel and refund an order affected by an obvious error.
• Payment must come from a method you are authorised to use. Third-party, stolen, disputed or obfuscated payments may be rejected.

Card details are handled by the relevant payment provider. Axion does not intentionally store complete payment-card numbers or security codes.

Digital delivery, cancellation and refunds

Programme access is normally supplied digitally after successful payment and any required checks. Delivery may include immediate access to a checkout configuration, dashboard, credentials, platform connection or other digital content.

Refund eligibility is governed by the Refund Policy, the terms of an advertised guarantee and mandatory consumer law. Except where those rules require otherwise, fees are not refundable after digital access, account credentials or a usable service have been supplied.

Nothing in these Terms removes any statutory right that cannot lawfully be excluded. Where local law provides a cooling-off right, that right may be affected once you expressly request immediate digital performance and acknowledge the consequences described during checkout.

Progression and performance rewards

Passing an evaluation or displaying a simulated profit does not create an automatic or unconditional right to money. Progression and rewards remain subject to the applicable programme rules, eligibility, identity verification, trading review, payment review and absence of prohibited conduct.

Axion may request trading explanations, platform records or supporting information reasonably needed to review a claim. A reward may be reduced, delayed, rejected or reversed where information is inaccurate, a rule was breached, the payment was disputed, the activity was manipulated, or law or sanctions prevent payment.

Where approved, a reward is a contractual payment made by Axion from its own resources. It is not a withdrawal of money held for you and does not represent the return of a deposit.

Acceptable use and prohibited conduct

You must not:

• interfere with, overload, scan, reverse engineer or attempt unauthorised access to the website, dashboard, APIs, payment bridge or trading infrastructure;
• use bots, scripts or automation to create accounts, abuse offers, manipulate tracking, submit fraudulent claims or evade limits;
• upload malware, unlawful material, personal data you are not entitled to provide, or content that infringes another person’s rights;
• misrepresent Axion, publish altered certificates, fabricate rewards or use Axion branding in a deceptive promotion;
• engage in fraud, chargeback abuse, money laundering, sanctions evasion or any activity that may expose Axion or its providers to legal, regulatory or reputational risk; or
• use the service in a manner prohibited by applicable programme rules.

Intellectual property and content licence

Axion and its licensors retain all rights in the website, interfaces, software, designs, graphics, text, data structures, certificates, educational content, trademarks and other materials. Subject to these Terms, Axion grants you a limited, personal, revocable, non-exclusive and non-transferable licence to use the service for its intended purpose.

You may not copy, resell, scrape, republish, create derivative products from, remove notices from or commercially exploit Axion materials without written permission.

If you submit feedback, suggestions, reviews or non-confidential ideas, you grant Axion a worldwide, royalty-free licence to use them to operate, market and improve the service. You retain ownership of your original content.

Third-party services and technical availability

The service may depend on payment processors, market-data providers, trading platforms, hosting services, identity providers, analytics tools and communication systems operated by third parties. Their services may be subject to separate terms and may be interrupted, delayed or changed without Axion’s control.

Axion does not guarantee uninterrupted or error-free access. Planned maintenance, cyber incidents, provider outages, market-data errors, internet failures and force-majeure events may affect availability. Axion will take commercially reasonable steps to restore affected services but is not responsible for failures outside its reasonable control.

Suspension, termination and account closure

Axion may suspend, restrict or terminate access where reasonably necessary to investigate a security issue, rule breach, payment dispute, identity concern, prohibited jurisdiction, legal request or material violation of these Terms.

You may stop using the service at any time. Closing an account does not erase payment obligations, completed transactions, audit records, intellectual-property restrictions, dispute rights or other provisions intended to survive termination.

Where practical and lawful, Axion will explain the reason for a material restriction and provide a channel to submit relevant evidence. Immediate action may be taken where delay would create security, fraud or legal risk.

Disclaimers and limitation of liability

The service is provided on an “as available” basis. To the maximum extent permitted by law, Axion disclaims implied warranties concerning uninterrupted availability, fitness for a particular trading result, profitability, market accuracy or compatibility with every device or third-party platform.

Axion does not guarantee that you will pass an evaluation, receive a reward, become profitable in live markets or achieve any advertised example. Simulated results and testimonials are not reliable indicators of future performance.

To the maximum extent permitted by law, Axion is not liable for indirect, incidental, special, punitive or consequential loss, loss of opportunity, lost trading profit, lost data or loss caused by third-party systems. Axion’s aggregate liability arising from a specific paid programme will not exceed the amount you paid for that programme during the twelve months preceding the claim, except where a higher liability cannot lawfully be excluded.

Nothing excludes liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or any liability that applicable law does not permit the parties to exclude.

Changes to services and these Terms

Axion may update the website, programmes, technical features and these Terms to reflect legal requirements, security needs, provider changes or service improvements. The updated date appears at the top of this page.

Material changes that affect an active paid programme will be communicated through the website, dashboard or email where reasonably practicable. Unless required for security, fraud prevention or law, a material rule change will not normally be applied retroactively to completed trading activity.

Continuing to use the service after an updated version becomes effective constitutes acceptance of the revised Terms. If you do not agree, stop using the service before the effective date.

Governing law, disputes and contact

These Terms are governed by the law applicable to the contracting entity identified on your order confirmation, without limiting any mandatory consumer protection that applies where you reside. Disputes are subject to the courts or dispute forum applicable to that contracting entity, unless mandatory law gives you the right to use another court or dispute process.

Before commencing formal proceedings, you agree to contact Axion and provide a reasonable opportunity to investigate. Include your account email, order number, a clear description and supporting evidence.
